Post-Brexit - what does this mean for UK employers

Now that we have officially left the EU, it is a time of transition, particularly for UK employers.

This will mean that UK legislation enacted after 31 December 2020 will take precedence over retained EU law.  The European Court of Justice will also no longer have jurisdiction over UK courts and its future decisions will not be binding.

So what impact could this have on UK employment law? 

Whilst nothing is set in stone, there could be a number of changes in the following areas:

  • A cap could be introduced on discrimination awards.
  • Trade union recognition could be made more difficult.
  • TUPE transfers could be made simpler.

The reality is that time will tell although we can expect some significant changes in employment law post-Brexit so watch this space.

What we do know is that there will be some changes that have come into effect from 1 January 2021 which includes:

  • A new immigration system will apply to people arriving in the UK and EU citizens moving to the UK to work will need to get a visa in advance.    EU citizens applying for a skilled worker visa will need to show they have a job offer from an approved employer sponsor to be able to apply. If you’re an employer planning to sponsor skilled migrants from 2021, and are not currently an approved sponsor, you should consider becoming one.  The link below will provide you with further details:

  • EU, EEA or Swiss citizens and their family members who are living in the UK before 1 January 2021 need to apply to the EU Settlement Scheme to continue living in the UK after 30 June 2021.  The links below will provide you with further details:
